Welcome to The Best Move. These Terms of Use (“Terms”) govern your access to and use of The Best Move mobile application, website, and related services (collectively, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
2. What The Best Move Is
The Best Move is a real-time wellness decision-support app designed to help users make better food and lifestyle choices in the moment without overthinking. The Services provide informational and educational guidance based on user inputs such as movement, workout timing, food context, and similar lifestyle factors.
The Best Move is not a calorie tracker, diet program, or medical service.

The Best Move provides general informational and educational content only. The Services are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

4. Eligibility and Children
The Services are not directed to children under 13, and The Best Move does not knowingly collect personal information from children under 13. You retain ownership of the content and information you submit, but you grant The Best Move a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and display that information as needed to operate, improve, and support the Services.
You are responsible for ensuring that the information you submit is lawful and does not violate the rights of others.
8. Subscriptions, Billing, and Trials
Some features of The Best Move may require a paid subscription or free trial. If you purchase a subscription through the Apple App Store or Google Play, your payment will be processed by Apple or Google, not by The Best Move directly.
Subscriptions may renew automatically unless canceled before renewal under the rules of the platform where you purchased them. You can manage or cancel your subscription through your Apple App Store or Google Play account settings.
Refunds, if available, are generally handled by Apple or Google under their own policies, not by The Best Move. Pricing, billing periods, and trial details will be shown in the app before purchase.
9. Third-Party Services
The Services rely on third-party tools and service providers to operate, including hosting, analytics, databases, authentication, AI processing, app distribution, and subscription management. These providers may process certain technical, account, usage, and app-related information on our behalf as needed to provide their services.
Use of third-party platforms such as Apple App Store and Google Play is also subject to those platforms’ own terms and policies.
10. Intellectual Property
The Best Move, including its software, design, text, graphics, branding, content, and other materials, is owned by or licensed to us and is protected by intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, non-commercial use in accordance with these Terms.
You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from the Services except as allowed by law or with our written permission.
11. No Warranty
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, The Best Move disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will always be available, uninterrupted, secure, accurate, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, The Best Move and its owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of or inability to use the Services.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of: (a) the amount you paid to use the Services in the 12 months before the claim arose, or (b) $100.
Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
13. Suspension and Termination
We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, created risk for us or others, or misused the Services. You may stop using the Services at any time.
Sections that by their nature should survive termination will continue to apply, including disclaimers, limitations of liability, intellectual property provisions, and dispute-related provisions.
14. Changes to the Services and Terms
We may update or modify the Services and these Terms from time to time. If we make material changes, we may notify you through the app, by email, or by other reasonable means. Your continued use of the Services after updated Terms take effect means you accept the revised Terms.
15. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles. Nothing in this section limits any consumer protection rights that may apply to you under mandatory law in your jurisdiction.
